California’s Unflavored Tobacco List (UTL): What It Is and Why It Matters Now
California has officially published its Unflavored Tobacco List (UTL), and it’s already changing how tobacco products are sold in the state. If you’re a retailer, distributor, or sell online into California, this list matters—because from here on out, if a product isn’t on it, it generally can’t be sold.
Here’s a quick breakdown of what the UTL is, how it works, and what it means for you.
So, What Is the UTL?
The UTL is a state-run list of tobacco products that California has reviewed and confirmed are not flavored. Now that the list is live, only products on the UTL—or a small group of exempt products—can be legally sold in California.
This is a big shift in how the state enforces its flavored tobacco ban. Instead of regulators deciding after the fact whether something “seems flavored,” California has flipped the process:
- If a product is on the UTL, it’s okay to sell
- If a product isn’t on the UTL, it’s assumed to be flavored—and therefore not allowed
That means the responsibility now sits with manufacturers and distributors to prove a product is unflavored before it ever reaches a store shelf.
What Products Are Exempt?
Most tobacco products sold as “unflavored” need to appear on the UTL. There are, however, a few limited exemptions.
One of the most common questions we hear is about pipe tobacco. Pipe tobacco is treated differently under the law and does not need to appear on the UTL to be sold.
There are also certain products explicitly exempted by statute, such as premium cigars that meet the legal definition.
These exemptions are narrow, and most products will need to be listed on the UTL to be legally sold. If it’s not clearly exempt, the safest assumption is that it should be on the list.

There’s really no gray area anymore:
Not on the UTL = not legal to sell.
